1. Acceptance of these conditions
The customer recognizes to have taken knowledge, at the time of the placing of order, of the particular conditions of sale stated on this screen and expressly declares to accept them without reserve. The present general conditions of sale govern the contractual relations between Oh My Frog and its customer, the two parts accepting them without reserve. These general conditions of sale will prevail over any other conditions appearing in any other document, except prior, express and written derogation.

Oh My Frog strives to present and describe its items as accurately as possible. However, a possible error or omission could not be imputed to Oh My Frog and in no case the responsibility of Oh My Frog could be committed for this reason. The photographs and videos can not be opposed to Oh My Frog.
The company Oh My Frog reserves the right not to record a payment, and not to confirm an order for some reason that it is, and more particularly in case of problem of supply, or in case of difficulty concerning the received order, or if there is a dispute relating to the payment of a former order.

After confirmation of order, Oh My Frog undertakes to deliver to its carrier all the references ordered by the buyer. This carrier undertakes by contract with Oh My Frog to deliver the order to the buyer’s address provided by Oh My Frog.
For deliveries outside metropolitan France, the customer agrees to pay all taxes due on the import of products, customs duty, value added tax, and any other taxes due under the laws of the country where the order is received.
All the orders placed with Oh My Frog are intended for the personal use of the customers, the customers or the recipients of the products prohibit themselves any partial or total resale of the products. Oh My Frog se dégage de fait de toute responsabilité juridique si l’acquittement des taxes n’était pas effectuée par le client.
In general, it takes us 1 to 4 days to process an order, after which it is shipped. Shipping time depends on your country, but can be estimated as follows:
- United States: 2-3 business days
- Europe: 1-3 business days
- Australia and New Zealand: 2-3 business days
- Japan : 2-3 working days
- International: 4-6 business days
We have chosen to deliver orders only to countries where we can produce them locally, in order to limit the CO² emissions caused by the delivery of our products. Here are the countries for which orders are possible:

- Australia and New Zealand
In accordance with the code of consumption, the customer can denounce the contract in the event of overtaking of the delivery date exceeding 7 days and not due to a case of force majeure. War, riot, fire, strikes, accidents and the impossibility of being supplied are considered as force majeure discharging the seller from his obligation to deliver. In accordance with the code of consumption, Oh My Frog is responsible for the good routing of the products and in a general way, responsible for the good execution of the contract.
Thus, except in cases of force majeure, the customer will not have to prove the fault of other parties in case of poor performance of the contract. The customer is advised to systematically check the package upon arrival and to refuse any damaged package. The customer has a period of 48 hours to make any reservations with the carrier in case of missing or damaged. For reasons of availability, an order can be delivered in several times to the customer. The customer only pays for one delivery. If the customer wants two places of delivery, it is necessary that he places two orders, with the related delivery costs.
In the event of deliveries by a conveyor, the company Oh My Frog cannot be held for person in charge of delay of delivery due exclusively to an unavailability of the customer after several proposals of appointment.
4. Packaging and shipping costs
Our posters are carefully rolled and wrapped, then placed in a thick cardboard box, protecting them from any shocks during shipping. Our delivery rates are as follows:
- Metropolitan France : 5,90€.
- France Overseas: 8,50€.
- European Union: 11,90€.
- USA: 22€.
- Rest of the world: 25€.
If customs duties or other additional taxes must be paid, these costs are to be borne by the customer.
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.
The returns are to be made :
- In their original condition and complete (packaging and accessories)
- To the following address: Oh My Frog, 2 rue des Aires, 13350 Charleval, France
- With a tracking number, to avoid lost or misplaced packages by carriers. You must provide us with the tracking number of your returned package, otherwise we will refuse the return.
Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal. Return shipping costs are at the customer’s expense.
In case of exercise of the right of retraction, the company Oh My Frog will proceed to the refunding of the paid sums, within 14 days maximum following the notification of your request and via the same means of payment that the one used during the order.
All prices presented on the site are in Euros and include all taxes. Oh My Frog reserves the right to modify its prices without notice and the prices applied to the Customer correspond to those displayed on the site at the time of his order. The goods remain the full property of Oh My Frog until receipt of the total amount due paid by the Customer. The price indicated on the product sheets does not include transport.
The price charged to the customer is the price indicated on the order confirmation sent by email by Oh My Frog. The price of the products is payable in cash the day of the effective order. Payment is made by credit card or PayPal.
Payments by credit card, Apple Pay, Google Pay etc. are handled by our partner Stripe. To place an order, you do not leave our site and no card data is stored on our servers. Stripe uses the highest level of certification for online payments: the PCI-DSS (Payment Card Industry Data Security Standard) Level 1 certification. At no time is Frog Posters in possession of your bank details, and the entire transaction is fully encrypted with the SSL encryption process.
You can also choose to pay via PayPal, either through your PayPal account or directly by credit card without having to create an account. PayPal is the leading e-wallet system, recognized worldwide for its reliability.
PayPal automatically encrypts your confidential information with the Secure Socket Layer (SSL) protocol with a 128-bit encryption key, which is the highest level available.
Your payment information and in particular your credit card codes are at no time brought to the knowledge of Oh My Frog: the transaction is carried out directly with Stripe or PayPal, which only informs us of the success or failure of the payment.
The order validated by the customer will be considered effective only when the banking payment centers concerned have given their agreement. In case of refusal of the said centers, the order will be automatically cancelled and the customer will be informed by e-mail.
Moreover, Oh My Frog reserves the right to refuse any order of a customer with whom would exist a litigation.
In case of non-conformity of a product sold, it can be returned, exchanged or refunded. All claims, requests for exchange or refund must be made by mail via our contact form within 30 days of delivery. The products must be returned to us in the state in which you received them with all the elements (accessories, packaging, instructions…) in accordance with the provisions specified in Article 5 “Withdrawal”. The shipping costs will be reimbursed on the basis of the invoiced rate and the return shipping costs will be reimbursed upon presentation of the receipts.
The products offered are in accordance with the French legislation in force. The responsibility for the company Oh My Frog could not be committed in the event of nonrespect of the legislation of the country where the product is delivered. It is your responsibility to check with local authorities about the possibility of importing or using the products or services you plan to order.
In addition, the company Oh My Frog could not be held for person in charge of the damage resulting from a bad use of the bought product. Finally the responsibility of the company Oh My Frog could not be committed for all the inconveniences or damage inherent in the use of the Internet network, in particular a rupture of service, an external intrusion or the presence of computer virus.
10. Applicable law in case of disputes
The language of this contract is French. This contract is subject to French law. In case of dispute, the French courts will have exclusive jurisdiction. Oh My Frog cannot be held for person in charge of the damage of any nature, as well material as immaterial or body, which could result from a bad functioning or from the bad use of the marketed products.
In case of difficulties in the application of the present contract, the purchaser has the possibility, before any legal action, to seek an amicable solution in particular with the assistance of a professional association, an association of consumers or any other council of his choice. Compliance with the provisions of this contract relating to the contractual guarantee presupposes that the buyer honours his financial commitments to the seller. Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to expose their situations. In case of dispute, the customer will address in priority to Oh My Frog to obtain a friendly solution.
11. Intellectual Property
All the elements present on the sites www.frogposters.com or www.frogposters.fr, that they are visual, textual or sound, are the exclusive property of Oh My Frog and are as such protected by the code of the intellectual property and the copyright. As such, any reproduction of the site www.frogposters.com or www.frogposters.fr, partial or complete, is strictly prohibited.
You may link to our website if you do so fairly and do not damage our reputation or take advantage of our good name. However, you may not establish such a link in such a way as to suggest a form of association if one does not exist. 12. Archiving of evidence
